AI Hallucinations in Court Papers: A Legal Nightmare Waiting to Happen

February 20, 2025/in Blog/by Michael Layland

Imagine this: One of your attorneys who is pressed for time turns to AI for their legal research – letting a chatbot generate case law citations. The brief looks solid, until opposing counsel (or worse, the judge) discovers that half the cases don’t exist. Now stop imagining, because this is the world we currently live in. Welcome to the era of AI hallucinations in the courtroom.

What’s an AI Hallucination?

AI hallucinations occur when the AI fabricates information. This can include case law, statutes, and legal precedents that sound real (but that don’t actually exist). These errors occur due to AI’s ability to generate reasonable – but unverified text. This leads lawyers down a dangerous path if they don’t double-check the results.

Real-World Troubles: When AI Lies in Legal Filings

This isn’t hypothetical – lawyers have already been caught submitting fake AI-generated citations. In Mata v. Avianca, Inc., an attorney used an AI for legal research, unknowingly citing cases which didn’t ever really exist. When the court discovered this, sanctions followed which tarnished reputations and triggered ethical concerns across the board.

Why AI Hallucinations Are a Legal Minefield

  1. Ethical Violations & Sanctions: Submitting false information to the court, even unintentionally, can lead to disciplinary action. The ABA Model Rules of Professional Conduct (Rule 3.3) require candor to the tribunal, and citing hallucinated cases directly violates that duty.
  2. Client Trust & Reputational Damage: Law firms thrive on credibility. A single AI mistake can undermine years of hard-earned client trust.
  3. Cybersecurity Risks: AI tools, especially cloud-based ones, may expose confidential client data if not used securely, creating additional compliance concerns.

How Law Firms Can Avoid AI-Generated Legal Objections

– Treat AI Like a Jr Associate: AI can be a useful tool, but it needs supervision. Just as a first-year associate’s work gets vetted, AI outputs should be checked for accuracy.
– Verify Every Citation: Never assume AI-generated case law is real. Always cross-check citations in LexisNexis, Westlaw, or official court databases.
– Use AI Wisely, Not Blindly: AI can streamline workflows, generate drafts, and assist with contract analysis, but it should never replace human legal judgment.
– Secure Your Clients Data: If your firm has made the jump to use AI, ensure it complies with industry cybersecurity standards. The last thing you want is AI leaking privileged information.

The Bottom Line: AI Is a Tool, Not a Lawyer

AI in the legal field isn’t going away any time soon, or ever. It’s just evolving. But law firms must use it strategically, ensuring that automation enhances efficiency, not liability. The priority isn’t only adopting new technology – it’s making sure it works securely, ethically, and accurately.

🔹 Your law firm’s reputation is everything. Don’t let AI hallucinations put it at risk. Need an IT partner who understands legal tech (and how to keep your data safe)? Let’s talk.

BONUS: Could you tell? The image for this week’s blog is AI generated as well! – While not perfect yet, these images are getting more and more life-like every single day!
